2026 MASTER LIABILITY WAIVER, RELEASE OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

1. AGREEMENT BY PAYMENT OR DEPOSIT (BINDING ACCEPTANCE)
By placing a deposit, submitting payment (partial or full), or taking possession of any rental equipment, the customer (“Renter”) agrees to be legally bound by this Liability Waiver and Release Agreement.
This agreement applies to:

The renter
-
Any additional riders
-
Any members of the renter’s group
-
Any person operating or using the rented equipment under the renter’s control
The renter represents that they have authority to accept this agreement on behalf of all participants in their group.
2. EQUIPMENT COVERED
This agreement applies to all micro-mobility and mobility equipment, including but not limited to:
• Electric wheelchairs
• Mobility scooters
• Standard/manual wheelchairs
• Electric bicycles (e-bikes)
• Electric scooters (standing and seated)
• Electric mopeds
• Any similar or replacement equipment provided by E-MILE
3. ASSUMPTION OF ALL RISKS
The renter acknowledges that use of micro-mobility equipment involves inherent and significant risks, including but not limited to:
• Collisions with pedestrians, vehicles, or objects
• Falls, tipping, or loss of control
• Mechanical failure or malfunction
• Road, sidewalk, or terrain hazards
• Weather-related hazards
• Negligence of other individuals
• Injury, disability, or death
The renter knowingly and voluntarily assumes ALL risks, whether known or unknown.
4. FULL RELEASE OF LIABILITY
To the maximum extent permitted by law, the renter releases, waives, and discharges:

Its owners, officers, employees, contractors, and affiliates

Property owners and landlords
-
Event organizers and partners
-
Municipalities and jurisdictions
from ANY AND ALL claims, including but not limited to:
• Personal injury or death
• Property damage
• Loss or theft
• Claims arising from negligence (INCLUDING E-MILE’S OWN NEGLIGENCE, WHERE PERMITTED BY LAW)
5. INDEMNIFICATION & DEFENSE (VERY IMPORTANT CLAUSE)
The renter agrees to defend, indemnify, and hold harmless E-MILE from any and all claims, damages, liabilities, costs, and legal fees arising from:
• Use or misuse of equipment
• Injury to any third party or bystander
• Property damage
• Unauthorized use of equipment
• Violation of laws or regulations
This includes the obligation to pay for E-MILE’s legal defense costs.
6. GROUP LIABILITY
If equipment is rented for multiple users:

The renter is fully responsible for all participants

The renter assumes liability for any damage, injury, or claims caused by any member of their group

All group participants are deemed bound by this agreement
7. SAFE OPERATION REQUIREMENTS
The renter agrees to:
• Operate equipment safely and responsibly
• Follow all local, state, and federal laws
• Yield to pedestrians at all times
• Avoid reckless, negligent, or impaired operation
• Not exceed manufacturer weight limits
• Not use equipment under the influence of drugs or alcohol
• Not allow unauthorized users
E-MILE reserves the right to terminate rentals immediately without refund for unsafe use.
8. DAMAGE, LOSS, AND THEFT
The renter agrees to be fully financially responsible for:
• Damage to equipment
• Theft or loss
• Vandalism
• Damage to third-party property
Charges may include:
• Full replacement value
• Repair costs
• Loss-of-use fees
• Collection costs
9. EQUIPMENT CONDITION (AS-IS)
All equipment is provided “AS IS” without warranties.
The renter acknowledges:
• Equipment has been inspected
• They accept responsibility upon possession
• They will report issues immediately
10. NO MEDICAL LIABILITY
E-MILE is not a medical provider.
All equipment is provided for mobility convenience only, not medical treatment or supervision.
11. INSURANCE DISCLAIMER
The renter understands:
• E-MILE does not provide insurance coverage for renters
• The renter is responsible for any personal insurance
12. PHOTO, VIDEO & INCIDENT DOCUMENTATION
E-MILE may document:
• Equipment condition
• Accidents or incidents
• Customer interactions
This may be used for legal, insurance, or operational purposes.
13. GOVERNING LAW & VENUE
This agreement shall be governed by the laws of:

Washington, DC

Maryland
-
Virginia
Any legal action shall be brought in a jurisdiction selected by E-MILE within these regions.
14. SEVERABILITY
If any provision is found unenforceable, all remaining provisions remain in full force.
15. CLASS ACTION WAIVER
The renter agrees that any claims must be brought individually and not as part of a class action.
16. ACKNOWLEDGMENT OF WAIVER
By placing a deposit, making payment, or using equipment, the renter acknowledges:
• They have read or had the opportunity to read this agreement
• They understand they are waiving legal rights
• They voluntarily agree to all terms
